Terms of service.

These cover this website, its assistant, and our automated replies on Instagram. Paid work is covered by a separate written agreement, not by this page.

What this covers

This site describes our services and lets you start a conversation with us. The assistant answers questions about the studio, and the Start a build form sends us a brief. Using either does not create a contract, and it does not oblige either of us to go ahead with a project.

Automated replies

Replies from the assistant on this site, and replies to comments and direct messages on our Instagram account, are generated by an automated system. Direct message replies are reviewed by a person before they are sent. Public comment replies may be published automatically.

An automated reply is information, not an offer. It does not commit us to a price, a timeline, a scope of work, or a result. Nothing the assistant says forms part of any agreement between us. If a reply conflicts with a written proposal or signed agreement, the written document is what counts.

We work to keep these replies accurate and grounded in our own documented information, and the system is built to hand anything it is unsure about to a person rather than guess. Even so, an automated system can be wrong or incomplete. Please confirm anything important with us directly before relying on it.

Using this site fairly

Please do not:

send us unlawful, abusive, misleading or infringing content,
submit someone else's personal data without their knowledge,
interfere with, overload, or gain unauthorised access to the site or the systems behind it,
use automated tools to scrape the site or flood our forms,
attempt to manipulate the assistant into behaving outside its intended purpose.

We limit how many messages one visitor can send in a period, to keep the service available for everyone. We may decline to reply, or stop replying, to anyone who misuses these channels.

Your content, and ours

Anything you send us in an enquiry stays yours. By sending it, you give us permission to read it, store it and use it to reply to you and prepare a proposal. We treat briefs as confidential, and we do not share client identities or work publicly without permission. See the privacy policy for how the data is handled.

The content of this site, including its text, design and images, belongs to ADK Creatives. Work we produce under a paid engagement belongs to the client on the terms set out in that project's written agreement.

Availability

We do not promise that the site or the assistant will be available without interruption or free of errors. We may change, suspend or withdraw any part of them at any time. Where a service depends on a third party, such as Instagram, its availability is outside our control.

Liability

To the extent the law allows, we are not liable for loss arising from your use of this site or from reliance on an automated reply, including lost profit, lost business or indirect loss. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

Third-party services

Our Instagram automation operates within Meta's platform and is subject to Meta's own terms and policies as well as these. Links from this site to other websites are provided for convenience, and we are not responsible for their content.

Changes

We may update these terms. The current version is always on this page, with the date at the top. Continuing to use the site after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the Republic of Ghana. The courts of Ghana have exclusive jurisdiction over any dispute arising from them.
